Terms of Service

1. Eligibility

You must be at least 17 years of age to use Pharmingo. By using the App, you represent and warrant that:

• You are at least 17 years old (or the age of majority in your jurisdiction, whichever is greater).
• You have the legal capacity to enter into these Terms.
• You are not barred from using the App under any applicable law.
• If you are using the App on behalf of an institution (e.g., a university), you have the authority to bind that institution to these Terms.

2. Account Registration & Security

2.1 Account Creation

To access certain features, you must create an account using one of the supported methods: email and password, Google Sign-In, Apple Sign-In, or phone number verification. You agree to provide accurate, current, and complete information during registration.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Choose a strong, unique password and keep it confidential.
• Immediately notify us at support@pharmingo.app if you suspect unauthorized access to your account.
• Not share your account with any other person.

2.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to abuse rewards, leaderboards, challenges, or any other system is prohibited and may result in termination of all associated accounts.

3. Description of Service

Pharmingo is a mobile learning platform designed to teach pharmacology through interactive lessons, quizzes, and gamified experiences. The App provides:

• Structured Learning Paths: Organized pharmacology content across multiple sections and nodes covering drug classes, mechanisms of action, clinical applications, and more.
• Interactive Quizzes: Multiple question formats including multiple choice, fill-in-the-blank, matching, ordering, image-based questions, dose calculations, and flashcards.
• Gamification: Experience points (XP), gems, streaks, hearts/energy system, levels, daily quests, weekly goals, leagues, and achievements.
• Social Features: Follow other users, view leaderboards, send and receive challenges, and track friends' progress.
• Premium Features: Ad-free experience, unlimited hearts, XP boosts, and additional features available through subscription.

4. Virtual Currency & Rewards

4.1 Gems

Gems are the App's virtual currency. Gems can be earned through gameplay (completing lessons, daily quests, achievements, streak rewards) or purchased through in-app purchases. Gems can be used to:

• Refill hearts/energy.
• Purchase streak freezes and other in-app items.
• Unlock bonus content or features.

4.2 No Real-World Value

Gems, XP, streak counts, achievements, league rankings, and all other virtual items or rewards within the App have no real-world monetary value and cannot be redeemed for cash, transferred, sold, or exchanged outside the App. We reserve the right to modify, adjust, or reset virtual currency balances at any time.

4.3 No Refund on Virtual Goods

Purchases of gems or other virtual goods are final. Refunds are handled exclusively through Apple's App Store refund policy.

5. Subscriptions & In-App Purchases

5.1 Pharmingo Super Subscription

Pharmingo offers a premium subscription plan ("Pharmingo Super") that provides enhanced features including ad-free experience, unlimited hearts, XP boosts, and additional premium content. Subscription details and pricing are displayed within the App.

5.2 Billing & Renewal

• All subscriptions are billed through your Apple App Store account.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your App Store account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

5.3 Managing Your Subscription

You can manage or cancel your subscription at any time through your device's App Store settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.

5.4 Price Changes

We reserve the right to change subscription pricing. You will be notified of any price changes in advance, and the new pricing will apply to the next renewal period after notification.

5.5 Refunds

Refund requests for subscriptions and in-app purchases are handled by Apple in accordance with their refund policies. We do not process refunds directly.

6. Free Trial & Promotional Offers

We may offer free trial periods or promotional pricing for Pharmingo Super. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the standard rate. Trial eligibility is determined by Apple and is typically limited to one trial per Apple ID.

7. User Conduct

You agree to use Pharmingo responsibly and in compliance with these Terms. You agree not to:

• Use the App for any unlawful, fraudulent, or malicious purpose.
• Create fake accounts, impersonate other users, or misrepresent your identity.
• Manipulate or exploit the App's gamification systems, including but not limited to: artificially inflating XP, gems, streak counts, league rankings, or achievement progress.
• Use bots, scripts, automation tools, or any non-human means to interact with the App.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Circumvent, disable, or interfere with any security or access-restriction features.
• Harass, bully, threaten, or intimidate other users through any social features.
• Upload, share, or transmit content that is offensive, harmful, defamatory, obscene, or that violates the rights of any third party.
• Collect or harvest personal information of other users.
• Use the App's educational content for commercial purposes without our written permission.
• Distribute, reproduce, or publicly display any of the App's content without authorization.

8. Social Features & User Interactions

8.1 Public Profile

When you create an account, certain information becomes visible to other users, including your display name, username, profile picture, level, XP, streak, league ranking, and achievements. You can manage your visibility settings within the App.

8.2 Following & Followers

You can follow other users and accept follow requests. You may block or unfollow users at any time. We are not responsible for interactions between users.

8.3 Challenges

Users may send quiz challenges to other users. Challenge participation is voluntary. We reserve the right to modify or discontinue the challenge system at any time.

8.4 Reporting

If you encounter inappropriate behavior or content, please report it to support@pharmingo.app. We will review reports and take appropriate action, which may include warnings, suspensions, or account termination.

9. Intellectual Property

9.1 Our Content

All content within the App — including but not limited to text, graphics, logos, icons, images, audio, video, software, quiz questions, lesson materials, animations, node artwork, and the overall design and layout — is the exclusive property of Pharmingo or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial educational purposes, subject to these Terms. This license does not include the right to:

• Reproduce, distribute, or publicly display any App content.
• Modify, create derivative works from, or reverse engineer the App.
• Use the App's content for commercial purposes, including creating competing educational products.
• Remove any copyright, trademark, or proprietary notices from the App.

9.3 Trademarks

"Pharmingo," the Pharmingo logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pharmingo. You may not use these marks without our prior written permission.

10. User Content

10.1 Your Content

You retain ownership of any content you submit through the App (e.g., profile information, feedback, quiz feedback reports). By submitting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with operating and improving the App.

10.2 Content Standards

You represent that any content you submit does not violate any law or the rights of any third party and is not offensive, harmful, or misleading.

10.3 Content Removal

We reserve the right to remove any user content that violates these Terms or that we determine, in our sole discretion, is inappropriate or harmful.

11. Disclaimers & Medical Information

• The App is not a substitute for professional medical advice, diagnosis, or treatment.
• The App is not intended for use in clinical decision-making or patient care.
• Drug information, dosages, and clinical data may be simplified for educational purposes and may not reflect the most current clinical guidelines.
• Always consult qualified healthcare professionals and official drug references for clinical decisions.
• We do not guarantee the accuracy, completeness, or timeliness of any educational content.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any defects will be corrected in a timely manner.
• The results obtained from the App will be accurate or reliable.
• The App will meet your specific requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHARMINGO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, profits, or revenue.
• Cost of substitute services.
• Personal injury or property damage arising from your use of or inability to use the App.
• Any unauthorized access to or alteration of your data.
• Any reliance on educational content provided through the App.

Our total aggregate liability for all claims arising from or related to these Terms or the App shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) fifty US dollars (USD $50).

13. Indemnification

You agree to indemnify, defend, and hold harmless Pharmingo, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any rights of any third party.
• Any clinical or medical decisions made based on information obtained through the App.

14. Termination

14.1 Termination by You

You may stop using the App and delete your account at any time through the App (Settings → Account → Delete Account) or by contacting support@pharmingo.app.

14.2 Termination by Us

We reserve the right to suspend or terminate your account, without prior notice, if:

• You violate these Terms or our community guidelines.
• You engage in fraudulent, abusive, or harmful activity.
• We are required to do so by law.
• We discontinue the App or any part of the service.

14.3 Effect of Termination

Upon termination, your license to use the App is immediately revoked. You will lose access to your account, progress data, virtual currency, and all associated content. Active subscriptions should be cancelled separately through the App Store to avoid further charges. Sections 9, 11, 12, 13, and 17 survive termination.

15. Modifications to the Service

We reserve the right to modify, update, suspend, or discontinue any aspect of the App at any time, including but not limited to:

• Adding, modifying, or removing lessons, quizzes, or educational content.
• Changing the gamification system (XP values, gem rewards, streak mechanics, league structure).
• Updating or redesigning the user interface.
• Introducing, modifying, or removing features.

We will make reasonable efforts to provide notice of significant changes, but are not obligated to do so. Continued use of the App after changes constitutes acceptance.

16. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App (via in-app notification or banner) and by updating the "Last Updated" date. Your continued use of the App after any revision constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Pharmingo operates, without regard to conflict of law principles.

17.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration or the appropriate courts in the governing jurisdiction.

17.3 Class Action Waiver

To the fullest extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in a class action, collective action, or representative proceeding.

18. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pharmingo regarding your use of the App.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
• Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet/infrastructure failures.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
